Virtual Divorce – Terms of Service and Conditions of Use

Please read this Terms of Service and Conditions of Use (“Agreement”) carefully. By accessing or using the Virtual Divorce website (the “Website”) and related services (the “Services”), you agree to be bound by this Agreement. If you disagree, do not use the Website.By checking the box “I agree to the Website Terms of Service and Conditions of Use,” you adopt the checkbox as your electronic signature, and agree this electronic signature has the same effect as if signed in ink.

Purpose of the Website

Virtual Divorce provides an online platform that allows spouses who have already agreed to the terms of their divorce and have had their documents provided to them by an attorney or other drafting source to:
- Review and accept or reject attorney-prepared divorce documents.
- Electronically sign and notarize documents with an online notary.
- Optionally file documents with the court using available e-filing services, if offered.
Important: Virtual Divorce is not a law firm and does not provide legal advice, legal drafting, or attorney representation. If you require legal advice, you must consult with a licensed attorney in your jurisdiction.

Services Offered

The Services available on the Website include:
- Access to an online case portal.
- Document review and approval features.
- Online notarization of divorce documents.
- Optional court filing services, where available.
You are solely responsible for ensuring that your documents are accurate, complete, and appropriate for your jurisdiction and situation.

Service Fees

- Fees for Services will be clearly displayed at the time of purchase on this Website or the referring website.
- Additional third-party fees may apply for notary services, electronic filing, or credit card processing.
- All setup fees are non-refundable.
- All fees are for technology services only; no portion of any fee is for legal services or legal advice.

Pro Se Use and Spouse Participation

Virtual Divorce is designed to support agreed divorce matters where both spouses consent to the process. The Website makes the online review of documents efficient, allowing most parties to sign and notarize their documents online in states or counties that accept remote online notarization. This Website may be used in two circumstances:

1. Pro Se Couples:
Both spouses proceed without attorney representation and voluntarily choose to use the platform. In this case, each spouse confirms that they are self-represented, willing to participate, and will use the platform to review, sign, and notarize their documents.

2. One Spouse Represented: In some states, one spouse may be represented by an attorney of record who has prepared the divorce documents on that spouse’s behalf. In this case, the represented spouse’s attorney-client relationship is solely between the attorney and their client. The unrepresented spouse confirms that they understand they are not represented by that attorney, that they are proceeding pro se, and that they consent to participate in the Virtual Divorce process for document review, notarization, and optional filing. The unrepresented spouse further acknowledges that Virtual Divorce is not their attorney, does not provide legal advice, and does not create an attorney-client relationship.

In all cases, you acknowledge and agree that:
- Any notices or communications sent through the Virtual Divorce platform are system-generated and occur only when initiated by a spouse’s actions on the platform (such as uploading, reviewing, or approving documents).
- Such communications are not legal advice and are not attorney-to-party communications.
- By using the platform, you represent that your spouse has consented to participate in the process and to receive such communications.

4. Service Limitations:
- No Legal Advice: Virtual Divorce does not offer legal advice, opinions, recommendations, or attorney-client relationships.
- No Document Drafting: Virtual Divorce does not prepare divorce paperwork. It only provides tools for reviewing, signing, notarizing, and optionally filing documents prepared by others.
- Court Filing: If court filing services are offered, they are limited to transmitting documents on your behalf. Virtual Divorce does not guarantee court acceptance or provide representation in any proceeding.
- Account Expiration: Accounts expire 120 days from setup or 30 days after completion of the Services, whichever comes first.

5. Disclaimers:
- No Attorney-Client Relationship: Using this Website does not create an attorney-client relationship.
- Accuracy of Documents: You are solely responsible for the accuracy of any information provided and for reviewing your documents prior to signing or filing.
- Jurisdiction-Specific Rules: Court requirements vary by state and county. Virtual Divorce cannot guarantee acceptance of documents by your local court.

6. Limitation of Liability:
In no event shall Virtual Divorce be liable for any indirect, incidental, consequential, or special damages, including lost profits. Direct liability, if any, is limited to the amount you paid for the Services.

7. Refund Policy:
- Setup fees are non-refundable.
- Refunds for Services beyond setup are at the sole discretion of Virtual Divorce and only if Services have not yet been rendered.

8. Privacy Policy:
We collect and use personal information only as necessary to provide Services. Please see our full Privacy Policy for details.

9. Governing Law:
The laws of the State of Wyoming govern this Agreement. You agree to the exclusive jurisdiction of the courts located in Wyoming for any dispute arising out of this Agreement.

10. Modifications:
Virtual Divorce may amend these Terms at any time by posting updated terms on the Website. Continued use of the Services after changes are posted constitutes acceptance.

11. Severability:
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
